Kansas Expungement Eligibility Under K.S.A. 21-6614

Kansas expungement law is governed by K.S.A. 21-6614. Eligibility depends on the offense category and how much time has passed since you completed your sentence, probation, or parole. The clock starts when your supervision ends, not from the date of your arrest or conviction.

Waiting periods by offense category:

• Three-year waiting period: misdemeanors, traffic infractions, class D and E felonies, nongrid felonies, and nondrug grid severity levels 6 through 10
• Five-year waiting period: class A, B, and C felonies; nondrug grid severity levels 1 through 5; and a first DUI conviction
• Ten-year waiting period: a second or subsequent DUI conviction

Diversion agreements are also eligible for expungement under the same waiting period structure. Arrest records where charges were never filed, were dismissed, or resulted in acquittal may be expunged with no waiting period under K.S.A. 22-2410.

Offenses that can never be expunged include murder, rape, other sexual offenses, and any offense requiring registration under the Kansas Offender Registration Act. Kansas has no automatic expungement. A petition must be filed for each eligible offense separately.

The court docket filing fee for an expungement petition is currently $195, set by the Kansas Supreme Court, and is waived when the petition involves dismissed charges or an acquittal. Fees are subject to change; confirm the current amount when you file.

What Expungement Does & Doesn’t Do

After a Kansas court grants expungement, you’re treated as if you were never arrested, convicted, or placed on diversion for that offense in most circumstances. You can legally state in standard employment applications, housing applications, and civil inquiries that no such record exists.

The record is sealed, not destroyed. Law enforcement, courts, and certain licensed agencies retain access in limited circumstances defined by statute. The Kansas Bureau of Investigation is notified of the expungement order and in turn notifies relevant criminal justice agencies.

Certain positions still require disclosure of an expunged record, including law enforcement roles, private detective licenses, gaming and racing industry positions, and commercial driver’s licenses, among others listed in K.S.A. 21-6614. The Kansas Expungement Process: Filing to Final Record Update

The process begins with filing a petition in the court that handled the original conviction or diversion. For Riley County matters, that is Riley County District Court; for Geary County matters, it is Geary County District Court. The petition must include details about the conviction, the sentence imposed, and when supervision ended.

After filing, the prosecutor and arresting law enforcement agency are notified and may appear at the hearing, which is typically scheduled 60 or more days out. At the hearing, the judge must find that:

• You haven’t been convicted of a felony in the past two years, and no felony proceeding is pending against you
• Your circumstances and behavior warrant expungement
• Granting expungement is consistent with the public welfare

For felony petitions, the court must also find that your possession of a firearm isn’t likely to pose a threat to public safety. Once the court grants the order, the Kansas Bureau of Investigation processes the record update, which typically takes 8 to 12 weeks. From initial filing to a completed record update, the full process generally runs two to four months, depending on the county.
